Straightforward terms for a straightforward app. Please read them: they include important limits on how far you should rely on flight data and AI-generated guidance.
01Agreement to these terms
By downloading, installing or using the LateGate mobile application (the "App") or visiting lategate.app (the "Site"), you agree to these Terms of Use. If you do not agree, do not use LateGate.
LateGate is operated by WebShareSolutions LLC ("LateGate", "we", "us"). These terms apply to everyone who uses the App or the Site. For the App, these terms are the end user license agreement (EULA) between you and WebShareSolutions LLC.
These terms are concluded between you and WebShareSolutions LLC only, and not with Apple Inc. ("Apple"). WebShareSolutions LLC, not Apple, is solely responsible for the App and its content. Where these terms conflict with the Apple Media Services Terms and Conditions in effect on the date you accept them, the Apple terms prevail to the extent of the conflict.
02What LateGate does
LateGate is a flight disruption concierge that helps passengers deal with delays, cancellations, diversions and missed connections. Depending on your tier, the App provides some or all of the following:
- Flight status lookup, monitoring, push notifications and Live Activities
- Plain-English summaries of airline delay policies and US Department of Transportation passenger rights
- Issue reports submitted by other passengers on the same flight
- Connection Assist: an estimate of your chance of making a connecting flight
- Delay Concierge: AI-generated disruption analysis, guidance on what you may be entitled to, and suggested wording for conversations with airline staff
- Alternative flights, nearby airports and drive times, and links to third-party booking and claims services
LateGate is an information and referral service. We do not operate flights, sell tickets or guarantee any outcome for your journey. The guides and airport pages on the Site are general information only.
03License to use the App
Subject to these terms, WebShareSolutions LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
You may not rent, lease, lend, sell, redistribute or sublicense the App. Except where the law expressly allows it, you may not copy, decompile, reverse-engineer, disassemble or create derivative works of the App or any part of it. This license ends automatically if you breach these terms, and you must then stop using the App and delete it from your devices.
04Tiers and payments
- Basic is free and lets you look up flights and view status and rights information.
- Watch ($0.99 per trip) is a one-time purchase that monitors one trip, made up of one flight or two connecting flights, until the final flight lands. It is used up when that trip ends.
- Concierge ($3.99 per month) is an auto-renewing subscription that monitors up to three trips at once and includes the Delay Concierge.
All payments are processed by Apple through in-app purchase. We never receive or store your card details. Prices are shown in USD and may vary by region as set by Apple.
Auto-renewal. A Concierge subscription renews automatically at the end of each period, and your Apple Account is charged for the renewal, unless you cancel at least 24 hours before the period ends. You can manage or cancel a subscription at any time in your App Store account settings. Cancelling stops future renewals; you keep access until the end of the period already paid for.
Refunds. Purchases are non-refundable except where the law or Apple's policies require otherwise. Refund requests are handled by Apple.
05Flight data and alert accuracy
You acknowledge that:
- Data is third-party. Departure times, delays, cancellations, gates and airport status come from external providers, including AirLabs and the US Federal Aviation Administration. We do not create or independently verify this data.
- Alerts depend on those feeds. Notifications are triggered automatically when a provider updates its data. The timing is outside our control.
- Delivery is not guaranteed. Push notifications and Live Activities depend on your device settings, your network connection and Apple's delivery services.
- The airline and airport prevail. If LateGate and your airline or the airport disagree, the airline or airport is right.
We are not liable for any loss, cost or inconvenience caused by relying on flight data or alerts that turn out to be inaccurate, late or incomplete.
06Connection Assist
Connection Assist estimates how likely you are to make a connecting flight, using delay data for your first flight and published minimum connection times for the layover airport. It is an estimate. It cannot account for terminal changes, security or immigration queues, gate availability or airline boarding decisions.
Connection Assist is a decision-support tool. We are not responsible for missed connections or the costs that follow from them.
07AI-generated content and the Delay Concierge
The Delay Concierge uses a third-party large language model to generate analysis and suggested wording from the flight data and context available at the time. By using it, you accept that:
- It is information, not legal advice. Its view of whether a delay is within the airline's control, and of what you may be entitled to, is guidance to help you ask the right questions.
- It can be wrong. It may misclassify a delay, overstate or understate what you are owed, or suggest wording that does not fit your situation.
- It is limited by its inputs. If the underlying flight, FAA or airline policy data is incomplete or out of date, the output will be too.
- Outcomes are not guaranteed. Airlines decide what they provide. Using a suggested script does not oblige an airline to agree.
Fair-use limits apply to the number of Concierge requests you can make in a given period.
08Passenger issue reports
Eligible users can report issues, such as a delay, for a flight they are monitoring. Reports are shown to other users monitoring the same flight as unverified signals. If you submit a report, you agree that it reflects what you are personally seeing, that it is not false or misleading, and that it may be shown to other users without identifying you.
We do not verify reports and are not responsible for decisions made in reliance on them. We may remove reports and restrict reporting for anyone who misuses it.
09App analytics (TelemetryDeck)
We use the privacy-friendly analytics service TelemetryDeck (provider: TelemetryDeck GmbH, Von-der-Tann-Str. 54, 86159 Augsburg, Germany) to understand how the App is used, so we can fix problems and improve it. Where the EU or UK GDPR applies, the legal basis is Art. 6(1)(b) GDPR: we need reliable and efficient tools for collecting App usage data in order to provide the service under our contract with you.
What is sent. The data processed by TelemetryDeck is anonymized and does not allow conclusions to be drawn about who you are. It includes, among other things:
- an anonymized user identifier. By default this is a random identifier for your App installation. When you are signed in, it is a one-way hash of your LateGate account number, created on your device, so the raw number is never sent;
- a short, fixed list of App events we have defined (for example, "app launched", "flight added", "alert opened", "purchase completed");
- a timestamp rounded to the nearest hour;
- device metadata, such as the iOS version, App version and device type;
- additional event details we have defined, such as which tier was purchased or whether a flight search found a result.
What is not stored. TelemetryDeck does not store IP addresses (in logs or in its database), does not use cookies or other tracking technologies, and does not keep persistent identifiers that could be traced back to you. We do not send your name, email address or flight details to TelemetryDeck.

10Third-party links and partner services
The App and Site link to third-party services, such as flight and car rental booking sites, compensation claim services and airline and government websites. Some of these are affiliate links, which means we may earn a commission if you make a purchase. This does not change the price you pay.
When you follow a link you leave LateGate. Any booking, payment or contract is between you and that provider, under its own terms and privacy policy. We are not responsible for its prices, availability or service.
11Passenger rights information
Information about passenger rights and airline policies, in the App and on the Site, is provided as a general educational guide. It is not legal advice, may not reflect the latest rules, and may not apply to your airline, route, ticket or circumstances. Check with your airline, the US Department of Transportation or a qualified adviser before acting on it.
12Your account
Monitoring and paid features require an account, created with an email address and password or with Sign in with Apple. You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you suspect unauthorized access.
You must be at least 13 years old to use LateGate. You can delete your account at any time from within the App.
13Acceptable use
You agree not to:
- use LateGate for anything unlawful or in breach of these terms;
- reverse-engineer, scrape or interfere with the App, the Site or our backend services, or access them with automated tools;
- submit false, misleading or fraudulent information, including issue reports;
- attempt to gain unauthorized access to our systems or to other users' data;
- use the Delay Concierge to produce content intended to deceive, harass or mislead airline staff or anyone else.
14Intellectual property
The LateGate name, logo, design, text and software belong to WebShareSolutions LLC or its licensors and are protected by intellectual property law. You may not copy, reproduce or distribute them without our written permission. Airline names and trademarks belong to their owners and are used only to identify the airlines concerned.
15Disclaimer of warranties
The App, the Site and all content, including flight data, connection estimates, passenger reports and Delay Concierge output, are provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that they will be uninterrupted, error-free, accurate, complete or up to date.
WebShareSolutions LLC, not Apple, is solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are the sole responsibility of WebShareSolutions LLC.
16Limitation of liability
To the fullest extent permitted by law, LateGate is not liable for indirect, incidental, special, consequential or punitive damages, including missed flights, missed connections, rebooking, accommodation or other travel costs, arising from your use of or reliance on the App or the Site.
Our total liability to you for any claim is limited to the greater of (a) the amount you paid us in the twelve months before the claim and (b) US $10. Nothing in these terms limits liability that cannot be limited by law, or any rights you have as a consumer that cannot be waived.
17Apple App Store terms
If you downloaded the App from Apple's App Store, you and WebShareSolutions LLC also agree that:
- Support. WebShareSolutions LLC is solely responsible for providing maintenance and support for the App, as described in these terms or as required by law. Apple has no obligation to provide any maintenance or support for the App. For help, contact us.
- Product claims. WebShareSolutions LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
- Intellectual property claims. If a third party claims that the App, or your possession and use of it, infringes that third party's intellectual property rights, WebShareSolutions LLC, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- Third-party terms. You must comply with any applicable third-party terms when using the App, such as your mobile carrier's data plan agreement and the terms of any booking or claims service you use through a link in the App.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
18Export and sanctions compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
19Changes to these terms
We may update these terms from time to time. When we do, we will change the "last updated" date at the top of this page. If you keep using LateGate after changes take effect, you accept the revised terms.
20Governing law
These terms are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms, the App or the Site is subject to the exclusive jurisdiction of the state and federal courts located in the State of New York, and you consent to the personal jurisdiction of those courts. This does not affect any mandatory consumer protections, or any right to bring a claim in your local courts, that the law of the country where you live gives you.
